General Terms and Conditions
The general terms and conditions of IZZI Beauty BV for treatments, training courses and transactions.
1. General
These terms and conditions apply to every offer, treatment, training course and transaction between IZZI Brows / IZZI Beauty BV and a client to whom IZZI Brows / IZZI Beauty BV has declared these terms and conditions applicable, except to the extent that the parties have expressly departed from them in writing.
Contact details of IZZI Beauty BV: Koningin Wilhelminaplein 13, 1062 HH Amsterdam; Weena 95, 3013 CH Rotterdam; info@izzi-beauty.com; +31 6 11 76 88 81; Chamber of Commerce (KVK) number 86970283; www.izzi-beauty.com.
2. Appointments
The client must notify IZZI Brows / IZZI Beauty by telephone, e-mail or message of any inability to attend an appointment as soon as possible and no later than 3 full working days before the appointment. For a training course, such notice must be given no later than 30 working days in advance.
IZZI Brows / IZZI Beauty will confirm receipt of this notice. If the client fails to comply with this obligation, or fails to do so in good time, IZZI Brows / IZZI Beauty is entitled to charge the client 50% of the agreed amount. If the client arrives at the practice more than fifteen minutes after the agreed time, IZZI Brows / IZZI Beauty may refuse the treatment and charge 50% of the agreed amount. The client is at all times personally responsible for keeping the appointment made. Neither party is required to comply with these obligations if prevented by force majeure (overmacht). Force majeure includes whatever statute and case law provide in that regard.
The client pays a deposit of 25% of the booked treatment, which is non-refundable. The amount may be spent on treatments within one year, after which the deposit lapses. The appointment may be rescheduled once up to 3 working days before the scheduled appointment. Cancellation is possible up to 3 working days before the scheduled appointment; however, the deposit will not be refunded.
Touch-up treatments: following a new treatment (eyebrows and lips, excluding cover-ups and colour corrections), everyone is entitled to a touch-up treatment after 6-8 weeks. During the touch-up the colour is re-applied and the shape may be refined. A touch-up treatment cannot be booked online by yourself, but can be booked through the salon. A touch-up is intended to be carried out after 6-8 weeks at the latest, because the pigment particles are then still largely present in the skin following the first treatment. If you come later than 8 weeks, a charge of €50.00 or more per treatment will apply. Too much time will then have elapsed between the first and second treatments, and it takes us more time to re-implant pigment in the skin. Please make sure that you book a touch-up in good time.
3. Payment
IZZI Brows / IZZI Beauty displays all prices of treatments and products visibly on the website. Prices include VAT unless stated otherwise. Offers in advertisements are valid for the stated period and/or while stocks last. Immediately after the treatment, the client must pay for the treatment and any products in cash or by debit card.
If an appointment is missed, 50% of the amount will be charged. An invoice will be sent, which must be paid within 7 days. If the payment period is exceeded, three reminders will follow. If the invoice remains unpaid after that, IZZI Brows / IZZI Beauty will hand the invoice over to a debt collection agency. The associated costs will be borne by the client.
If the client has previously had permanent make-up applied, she is obliged to inform IZZI Brows / IZZI Beauty of this before making an appointment, as indicated in the booking process and in the confirmation e-mail. In some cases it is not possible to carry out a treatment over old permanent make-up. If this is not discussed in advance, the full amount will be charged.
The client is obliged to pay the full amount when making an appointment or registering for a training course, and agrees to this by doing so. If payment in instalments is chosen for a training course, invoicing takes place monthly, starting the month after registration. We apply a payment term of 7 days from the invoice date.
4. Personal data and privacy
Before the first treatment, the client provides IZZI Brows / IZZI Beauty with all information that IZZI Brows / IZZI Beauty indicates is necessary, or that the client can reasonably be expected to understand is necessary, for the careful performance of the treatments. IZZI Brows / IZZI Beauty records the client's personal data in its records. IZZI Brows / IZZI Beauty handles the client's confidential data in accordance with the applicable data protection legislation (the Dutch Personal Data Protection Act, Wet Bescherming Persoonsgegevens). IZZI Brows / IZZI Beauty will not sell or rent out the client's data to third parties without the client's prior written consent. IZZI Brows / IZZI Beauty uses the client's e-mail address to send a digital newsletter; if the client does not wish to receive it, the client may indicate this in advance or unsubscribe from the newsletter.
5. Confidentiality
IZZI Brows / IZZI Beauty is bound to secrecy regarding all confidential information that the client has disclosed during the treatment. Information is confidential if the client has disclosed it as such or if this follows from the nature of the information. The duty of confidentiality lapses if IZZI Brows / IZZI Beauty is obliged to disclose the confidential information to third parties by virtue of a statutory provision or a court ruling.
During a training course that is paid for in instalments, a photograph will be taken of your ID card, driving licence or passport, with your citizen service number (BSN) covered. This is to prevent instalments from going unpaid. You automatically agree to this when you book a training course.
You are obliged to agree to keep confidential all information that you obtain through the training course. Distributing or storing photographic, video or text material of IZZI Brows / IZZI Beauty may result in criminal prosecution. In that event we will take all available action and have a lawyer commence proceedings.
6. Liability
IZZI Brows / IZZI Beauty is not liable for damage of any kind arising from IZZI Brows / IZZI Beauty having relied on incorrect and/or incomplete information provided by the client about relevant physical conditions, medication use, work or leisure activities. IZZI Brows / IZZI Beauty is not liable for loss of, theft of or damage to personal belongings that the client has brought to the practice.
7. Damage and theft
IZZI Brows / IZZI Beauty has the right to claim compensation from the client if the client damages furniture, equipment, products or other property. IZZI Brows / IZZI Beauty always reports theft to the police. Security cameras are present in our salon. IZZI Brows / IZZI Beauty is not liable for valuable personal belongings that a client leaves behind or loses.
8. Complaints
If the client has a complaint about the treatment or a product, it must be reported to IZZI Beauty BV as soon as possible and within two working days of discovery. IZZI Beauty BV will send a confirmation on receipt of the complaint and will give the complainant an adequate response within five working days. If a complaint is well-founded, IZZI Beauty BV will perform the treatment again as agreed, unless this has meanwhile demonstrably become pointless for the client. Some treatments, however, can only be corrected after 6 weeks because of the necessary healing process. If IZZI Brows / IZZI Beauty and the complainant cannot reach an agreement, the complainant may submit the dispute to the courts or to a mediator.
IZZI Beauty BV is affiliated with Zorg voor ZZP. If IZZI Beauty BV and the client cannot reach a solution, the client may submit the complaint to Zorg voor ZZP.
IZZI Brows / IZZI Beauty does not give refunds. We resolve complaints properly by establishing what went wrong and acting on it by means of a new treatment. If you do not wish to have a new treatment, that is also possible, but we will not refund any money.
9. Proper conduct
The client is expected to behave properly in the practice, in accordance with generally accepted standards. If the client continues to behave improperly after repeated warnings, IZZI Brows has the right to refuse the client access to the salon without giving reasons.
Children are not permitted in our salon, because of the work that we carry out. It is legally not possible to bring children under the age of 16. We therefore kindly ask you to take this into account.
10. Cancelling a treatment
A booked appointment can be cancelled. This must be done at least 3 full working days before the treatment is due to take place. The deposit is 25% of the total treatment amount and is non-refundable. A deposit remains valid for up to 1 year after the date of the treatment and can be redeemed against any type of treatment.
If a treatment is not cancelled in good time (3 full working days before the treatment appointment), we will charge 50% of the treatment. You will receive an invoice for this by e-mail.
Please bear in mind that rescheduling an appointment may take several weeks, because our diary is often fully booked.
11. Training courses
Once you have registered in person for a training course via our website or by e-mail, the date and the course are fixed. A training date can, however, be rescheduled once; this must be discussed with IZZI Brows / IZZI Beauty by e-mail or telephone.
Registering via the website or by e-mail fixes a training course and date. IZZI Brows / IZZI Beauty applies a non-refundable deposit. This means that a paid and confirmed training course is binding and the deposit will not be refunded.
If a training course is cancelled after online access to the IZZI Brows / IZZI Beauty online learning platform has already been granted, the full amount of the course must be paid. If you have chosen instalments, we will keep to these accordingly.
Training courses can be rescheduled once to another date up to 30 days in advance. After that, the training date is fixed. The instalments chosen for the training course in question are binding; this means that they cannot be departed from. Payments that are not made before a cancellation or for a training course will be recovered through a creditor, such as a bailiff (deurwaarder).
Training courses can be paid for in instalments. A deposit is charged at the time of online registration. The first chosen instalment is then paid on location on day 1, before the course begins. The remaining instalments will be invoiced monthly.
Our accredited certificate will only be sent to your personal address once all instalments have been paid. This allows us to maintain control over our quality, given that we list all students who have completed a training course with us on our website. This makes it easy for clients around the world to see whom we have trained.
If you have booked a training course that includes a return day, you can only cancel the return day up to 10 working days beforehand. If you cannot attend the return day, the hours lapse and you must schedule a new appointment. For a new return day, if not cancelled in good time, an amount of €100.00 will be charged. This must be paid on the day itself.
Online training courses
Taking an online training course has no prerequisites. After payment via the website, the course can be started in the learning environment.
Once an online training course has been purchased, this means that IZZI Beauty has delivered the product, together with the associated brand rights, and that it has been made visible to the client. This means that the amount paid for online training courses cannot be reimbursed, exchanged or refunded. Once access to the platform has been granted, it also gives access to the entire course and the unique material that IZZI Beauty itself supplies.
12. Image material
Before the treatment, the client is asked whether they consent to photographs and/or videos being taken. These are used for promotional purposes. If consent is not given, we will not use any image material of the client. Our training courses are filmed for promotional purposes.
13. Shipping of webshop products
Ordered before 16:00, shipped the same day. Products are shipped via PostNL, including a track and trace code.
Orders containing a PMU machine are sent by registered post, including insurance. You will also receive a track and trace code for these.
Order cannot be delivered after all: we continuously monitor our online range with the greatest possible care. Unfortunately, in exceptional cases it may happen that, while an order is being processed, an item turns out to be no longer in stock. If an item is unexpectedly unavailable, we will inform you within five working days and will refund the amount paid within 14 days.
Tracking your order: when your order is dispatched, you will receive a PostNL track and trace code by e-mail. You can use it to view the status of your order.
Cancelling an order: unfortunately we cannot cancel orders that have been placed, because they are processed automatically in our systems. Once you have received the order, you can return it.
Discount code: when completing your order, you can enter a discount code. If the discount amount and the invoice amount do not match, you must pay the outstanding amount using one of the payment methods.
PMU machine: when you order a PMU machine, you will receive it together with a personal card bearing a unique number. This unique number is proof of your warranty on the machine. The PMU machine can only be returned if the complete machine is intact, has not been unpacked, has not been used, and all products are present in proper condition. As with other webshop products, it can only be returned within 14 days. You can notify us of your return by e-mail.
14. Treatment conditions
1. If the consumer has had permanent make-up carried out elsewhere, the consumer must notify IZZI Beauty BV of this immediately. Even if, in the consumer's view, there is no longer any pigment in the skin, the consumer must still send photographs of the treated area to IZZI Beauty BV for assessment. This also applies if the consumer has the PMU applied by us removed by laser.
2. The consumer is aware that if the consumer attends a consultation with old permanent make-up on the area to be treated that has not been checked by IZZI Beauty BV by means of a photograph, and the treatment cannot proceed because of incorrect application, the amount of the full consultation will be charged as a result.
3. If the consumer has had permanent make-up carried out elsewhere, the treatment amount is charged as a first treatment, not as a touch-up treatment. Once the consumer has had a first treatment at IZZI Beauty BV, the consumer can have the permanent make-up touched up within the relevant payment period.
4. The consumer has chosen to have a treatment carried out of their own free will.
5. Before and during the treatment, the consumer is not under the influence of alcohol or drugs.
6. The consumer is aware that the permanent make-up treatment may carry risks, including infection, scarring and allergic reaction, if the aftercare is not properly followed.
7. During the treatment, the consumer has no discolouration, swelling, lumps or any other form of irritation or skin condition/disease in the treatment area, and considers themselves healthy enough to undergo the treatment.
8. The consumer is aware that high sebum production (oily skin) and/or scar tissue may mean that the pigment does not adhere as well in the skin. As a result, a third permanent make-up treatment (€75.00) may be necessary to achieve the desired result.
9. The consumer is aware that, where the treated area has undergone PMU remover or laser treatments to remove old PMU, increased cell renewal may mean that a third treatment (€50.00) is necessary to achieve the desired result.
10. The consumer is not pregnant and is not breastfeeding while the permanent make-up is applied. If the consumer is pregnant or breastfeeding at the consultation, IZZI Beauty BV may refuse the consumer and charge the full consultation for this.
11. The consumer is personally responsible for returning for a consultation within six and at most eight weeks after the first appointment to have the permanent make-up touched up. If this does not happen in good time, a charge of €75.00 will apply when a new appointment is made within < 3 months. This is because the specialist needs more time to restore the pigment of the permanent make-up that has been lost.
12. If the consumer has not cancelled the touch-up treatment at least 48 hours in advance, or has not attended the consultation, the touch-up amount (€75.00) is forfeited. If this does not happen in good time, a charge of €75.00 will apply when a new appointment is made within < 3 months. This is because the specialist needs more time to restore the pigment of the permanent make-up that has been lost.
13. If the consumer has had botox/fillers carried out in the treatment area without IZZI Beauty BV having given demonstrable approval, IZZI Beauty BV may refuse the consultation on the grounds of contraindication, disruption of facial expression or adhesion, as a result of which the product may possibly migrate. Where this applies, the full amount of the consultation will be charged to the consumer.
14. If the consumer has undergone a treatment and, on their own initiative, chooses to have the area treated by IZZI Beauty BV removed by laser, the warranty and any compensation by IZZI Beauty BV to the consumer lapse. IZZI Beauty BV is then no longer able to check and correct the area treated by IZZI Beauty BV, if the consumer has had the area touched up or lasered by someone else.
15. Liability (treatments and training courses)
1. IZZI Beauty BV hereby declares that it will perform the treatments and professional training to the best of its knowledge and ability and in accordance with the requirements of good workmanship. IZZI Beauty BV can never guarantee that it will achieve the intended result; in no event will this lead to a discount on, or refund of, the treatment amount.
2. IZZI Beauty BV is not liable for the student's failure to achieve the intended result, in whole or in part, during the practical lesson on the model; nor is IZZI Beauty BV liable for damage caused by the student during a practical lesson as a result of a treatment, unless it is established that the damage is attributable to its gross negligence or wilful misconduct.
3. IZZI Beauty BV is not liable for disfigurement or inflammation resulting from failure by the consumer or student to follow the aftercare instructions after treatment, from physical conditions, medication use, work or leisure activities, or from the provision of incorrect or incomplete information.
4. If IZZI Beauty BV is held liable for any damage suffered by the consumer, compensation will be limited to the amount that IZZI Beauty BV originally charged for the treatment in question.
5. Any right to compensation lapses in any event to the extent that the consumer/student/model has not, immediately after the damage arose, taken measures to limit the damage and to prevent further or other damage, and has not notified IZZI Beauty BV as soon as reasonably possible of all relevant information in this regard.
6. IZZI Beauty BV is not liable for loss of, theft of or damage to personal belongings that the consumer/student and model have brought to the salon.
7. IZZI Beauty BV is not responsible for what visitors or fellow students post on social media (website/Facebook/Instagram/Twitter etc.), for example in response to a post, and cannot be held liable for this.
