Training Course Terms — IZZI Beauty

General

General terms and conditions of the course agreement for the training courses of IZZI Beauty BV, hereinafter referred to as IZZI Beauty BV Training Courses, as at 1 January 2021.

1. Applicability

These terms and conditions apply to every workshop, course or training course, hereinafter referred to simply as a training course, as an agreement between IZZI Beauty BV Training Courses and a student to whom IZZI Beauty BV Training Courses has declared these terms and conditions applicable, except to the extent that the parties have expressly departed from them in writing.

2. Efforts

IZZI Beauty BV Training Courses will deliver the training course to the best of its judgement and ability, in accordance with the requirements of good workmanship and on the basis of the state of knowledge known at that time. IZZI Beauty BV Training Courses will, as far as reasonably possible, inform the student of the financial consequences of any change to or addition to the training course.

3. Registration

Registration as a student takes place by completing and submitting the online registration form for the training course in question, or by paying a deposit on a product for the desired date for taking the training course in question.

Upon registration, the student has entered into a course agreement with IZZI Beauty BV Training Courses.

Upon registration, the student is obliged to pay the full course fee. No administration costs are attached to registration itself.

4. Payment of the course fee

The course fee can be paid in cash or by debit card at the training location, or by transferring the amount to the bank account of IZZI Beauty BV Training Courses.

The student can only take part in the training course once the course fee, or, in the case of payment in instalments, the deposit agreed by arrangement, has been paid.

With the exception of the workshops, and solely after confirmation by IZZI Beauty BV Training Courses, payment in instalments is possible. No additional costs are charged for paying in instalments.

In order to receive the certificate, the full course fee must have been paid.

5. Cancellation

Provided that the student has not yet taken part in the practical lessons or started the online training, she has a 14-day cooling-off period after her registration (right of withdrawal) and may cancel the training course free of charge; any (deposit) payments made by the student will in this case be refunded immediately.

Provided that the student has not yet taken part in the lessons or started the online training, and wishes to cancel after a period of 14 days, the student will owe IZZI Beauty BV Training Courses 50% of the course fee. Cancellation is possible up to a maximum of 30 days before the chosen training dates. However, cancellation is not possible once a starter pack has been sent to your home for practising in combination with the online training. The starter pack and the online training are a complete preparation for the training course and can therefore no longer be cancelled. The PMU machine included in the starter pack, for practising at home, cannot be taken back by IZZI Beauty BV and must be paid for in full, including the full course fee.

If a private training course has been booked, it can be cancelled up to 30 days in advance. 50% will then be charged for booking and reserving these days for one individual. If it is not cancelled 30 days in advance, the student must pay 100% of the tuition fee.

Cancellation of the registration by the student is only possible in writing, by e-mail or post. The cancellation must be confirmed by IZZI Beauty BV Training Courses.

If the student does not take part in the training course without having cancelled, 100% of the course fee will be charged.

IZZI Beauty BV Training Courses reserves the right to cancel the training course; any (deposit) payments already made will then be refunded immediately.

If the student takes the exam on a model and the model cancels within 3 days beforehand, the exam must be rescheduled and a charge of €250.00 will apply.

6. Personal data and privacy

Before the first lesson day, the student provides IZZI Beauty BV Training Courses with all information that IZZI Beauty BV Training Courses indicates is necessary, or that the student can reasonably be expected to understand is necessary, for the careful delivery of the training course.

IZZI Beauty BV Training Courses records the student's personal data in an automated system. IZZI Beauty BV Training Courses handles the student's confidential data in accordance with the guidelines of the General Data Protection Regulation (GDPR). IZZI Beauty BV Training Courses will not sell or rent out the student's data to third parties without the student's prior written consent.

7. Confidentiality

IZZI Beauty BV Training Courses is bound to secrecy regarding all confidential information that the student has disclosed during the training course. Information is confidential if the student has disclosed it as such or if this follows from the nature of the information. The duty of confidentiality lapses if IZZI Beauty BV Training Courses is obliged to disclose the confidential information to third parties by virtue of a statutory provision or a court ruling.

8. Liability

IZZI Beauty BV Training Courses is not liable for damage of any kind arising from IZZI Beauty BV Training Courses having relied on incorrect and/or incomplete information provided by the student about relevant physical conditions, medication use, work or leisure activities.

IZZI Beauty BV Training Courses is not liable for loss of, theft of or damage to personal belongings that the student has brought to the training course.

9. Copyright and ownership

Course material that has been purchased becomes the property of the student after payment, but the copyright and ownership rights in the course material remain with IZZI Beauty BV Training Courses.

The material may not be reproduced or made public by means of printing, photocopying, microfilm or in any other way without the prior written consent of IZZI Beauty BV Training Courses.

It is not permitted to make the lesson or course material available to third parties.

Infringement of copyright or ownership rights is regarded as a criminal offence.

In the event of misuse of the name or logo of IZZI Beauty BV Training Courses, the student may be denied access to the training course.

10. Lessons, exams and resits

In consultation with the student, IZZI Beauty BV Training Courses draws up a personal lesson and exam schedule, setting out the lesson days, times and lesson content of the training course.

The student and IZZI Beauty BV Training Courses are obliged to adhere to this schedule.

With the exception of personal training, lessons are given in a classroom setting, with the teacher dividing attention evenly among all participants.

Unless otherwise indicated, practice takes place on live models; the student is personally responsible for arranging a model. If a model cancels, the lesson is given on latex (practice skin), and the right to cancel the lesson lapses.

Exams and a maximum of 2 resits per training course are free of charge. After that, exams cost €250.00 each.

Outside the lessons, the student can ask questions by e-mail or telephone, and IZZI Beauty BV Training Courses will answer these within a maximum of 2 working days.

11. Damage and theft

IZZI Beauty BV Training Courses has the right to claim compensation from the student if the student damages furniture, equipment or products. IZZI Beauty BV Training Courses always reports theft to the police.

12. Complaints

If the student is dissatisfied with the training course, she can submit a complaint by sending an e-mail to info@izzi-beauty.com.

IZZI Beauty BV Training Courses must give the complainant an adequate response within five working days. If it proves impossible to respond within the stated period of five working days, you will be informed of this as soon as possible, given an explanation, and told when we can give you a definitive answer.

If a complaint is well-founded, IZZI Beauty BV Training Courses will immediately come up with a solution or deliver again, as agreed, the part of the training course to which the complaint relates, unless this has meanwhile demonstrably become pointless for the student and the student notifies this in writing.

If IZZI Beauty BV Training Courses and the complainant cannot reach an agreement, the complainant may submit the dispute to Tutti Colori Nail Bar in Rotterdam, which acts in this respect as an independent expert. The opinion of this independent expert is binding on IZZI Beauty BV. Any consequences will be dealt with within 14 days.

Complaints are treated confidentially by all parties. Complaints are registered and retained for a maximum of two years.

13. End of the course agreement

The course agreement ends upon completion of the course or as provided in other articles of these general terms and conditions.

If the student fails to comply (fully) with one or more obligations under the course agreement, IZZI Beauty BV Training Courses is entitled to suspend its obligations and to interrupt or terminate the training course.

14. Proper conduct

The student is expected to behave properly in accordance with generally accepted standards. If the student continues to behave improperly after repeated warnings, IZZI Beauty BV Training Courses has the right to refuse the student access without giving reasons.

15. Governing law

Dutch law applies to every agreement between IZZI Beauty BV Training Courses and the student. These terms and conditions have been filed at the office of the Chamber of Commerce in Amsterdam. In the event of any dispute as to the content and purport of these general terms and conditions, the Dutch text shall always prevail.

The version last filed applies in each case, or the version as it applied at the time the agreement was concluded.
